In August, a federal court in New York struck down a number of the US Department of Labor’s regulations implementing the paid leave provisions of the Families First Coronavirus Response Act. As a result, employers with fewer than 500 employees are finding themselves in a legal quandary – do they conform to the now legally questionable regulations and risk later being found to be out of compliance with the law, or do they conform to the more employee-friendly construction found required by the court?
